Privacy Policy

This is a translation for convenience. Only the German version is legally binding.
This privacy policy explains which personal data is processed when you visit kynxmachines.de and when you use the KynxMachines software. In short: we use no cookies, no tracking, no analytics tools and no advertising, and KynxMachines does not require a user account.
1. Controller
The controller within the meaning of the General Data Protection Regulation (GDPR) is:

No data protection officer has been appointed, as the legal requirements for this are not met.
2. Visiting the website
When you access kynxmachines.de, the server processes technically necessary data that your browser transmits automatically:
- IP address,
- date and time of access,
- page or file requested, amount of data transferred and HTTP status code,
- browser type and version as well as operating system (user agent),
- where applicable, the previously visited page (referrer).
Purpose: delivering the website and downloads, ensuring stability and security (e.g. defending against attacks). Legal basis: Art. 6 (1) (f) GDPR – our legitimate interest in a secure and functional service.
Storage period: our web application itself does not write access logs containing IP addresses. The upstream web server may briefly keep access and error logs for security purposes; these are deleted after 7 days at the latest unless they are needed to investigate a specific security incident.
Cookies and tracking: the website sets no cookies, does not use your browser's local storage and does not embed any third-party content (no external fonts, no analytics services, no social media plugins). Consent is therefore not required.
3. Downloading the installer
When you download the installer, the same technical data is processed as when accessing the website (section 2). No registration or personal information is required.
4. The KynxMachines software
KynxMachines runs entirely locally on your computer. The software
- requires no user account,
- sends no telemetry, usage or crash data to us,
- transmits no content of your virtual machines to us.
Settings and logs (e.g. the chosen storage location, error logs) are stored exclusively locally on your device (under %APPDATA%\KynxMachines) and are not transmitted to us. Virtual machines and downloaded images are stored in the folder you choose on your computer. You can delete this data yourself at any time.
Shared clipboard: in Windows VMs, KynxMachines automatically installs the small helper program KynxClip (via the Hyper-V guest services, in the VM's autostart). When you paste in a VM view, KynxMachines transfers the content of your clipboard (text, images or files) directly into that VM via Hyper-V. If you copy something in the VM while its view is active, it is taken over to your PC's clipboard. The transfer takes place exclusively locally on your computer; no data is sent to us or third parties.
Sound mode: if you turn on sound for a Windows VM, KynxMachines shows it through the Hyper-V enhanced session (a Remote Desktop connection within your computer); picture and sound are transferred exclusively locally. The first time, after your confirmation in the VM, KynxClip sets up a scheduled task that returns the VM to its screen unlocked when sound mode ends, and allows signing in with a password. You enter your sign-in details directly in the VM; KynxMachines does not store them.
5. Automatic updates
So that you receive security and feature updates, KynxMachines regularly checks kynxmachines.de while it is running (currently about every 30 seconds) for a new version and downloads it if available. Only a small version file is requested for this. The following is transmitted to our server: IP address, time, requested file and a technical user agent (which includes, among other things, the installed version and the operating system).
Legal basis: Art. 6 (1) (b) GDPR (provision of the software under the terms of use) and Art. 6 (1) (f) GDPR (legitimate interest in secure, up-to-date software). Section 2 applies to the storage period.
6. Operating system downloads
When you create a VM with automatic download in KynxMachines, the software downloads the selected operating system image directly from the respective provider or retrieves its version index. In doing so, your IP address (and the usual technical connection data) is transmitted to the respective provider, who processes it under their own responsibility. Depending on your selection, these are:
- Windows 11: Microsoft Corporation or Microsoft Ireland Operations Ltd. – privacy statement
- Ubuntu: Canonical Group Ltd. – privacy policy
- Linux Mint (via the Linux Foundation's mirror server mirrors.edge.kernel.org) – privacy policy
- Fedora: Fedora Project / Red Hat – privacy policy
- Debian: Debian Project – privacy policy
These providers may also process data outside the EU (in particular in the USA). The download only takes place if you explicitly trigger it in the software. The legal basis is Art. 6 (1) (b) GDPR (a function requested by you). Alternatively, you can choose your own image file at any time; in that case no connection to these providers is made.
6a. Network protection (Tor, VPN, proxy)
You can optionally enable network protection for each VM. For this, KynxMachines sets up a small gateway VM on your computer through which all internet traffic of that VM runs. The following applies:
- Setup: when enabled for the first time, KynxMachines downloads the Alpine Linux operating system and the required packages from the official server of the Alpine project (dl-cdn.alpinelinux.org, delivered via Fastly's CDN). Your IP address is transmitted to this server.
- Tor: the VM's traffic is routed through the Tor network, which consists of servers operated by volunteers worldwide. The last server ("exit") can see unencrypted content but does not know your IP address. Information: The Tor Project – Privacy Policy.
- Your own VPN (e.g. Proton VPN) or proxy: the VM's traffic goes to the provider you have chosen and is subject to their privacy terms, for example the privacy policy of Proton AG for Proton VPN. Your configuration files and credentials are stored only locally on your computer (passwords encrypted) and are never transmitted to us.
- Status display: to show "Protected" and the externally visible IP address, the gateway VM regularly calls check.torproject.org (The Tor Project) through the respective tunnel. This service only sees the tunnel's IP address, not your own.
The legal basis is Art. 6 (1) (b) GDPR (a function enabled by you). Without enabling network protection, these connections do not take place. We ourselves receive no data whatsoever about the traffic of your VMs.
7. Contact by email
If you contact us by email, we process your email address, your name (if provided) and the content of your message in order to handle your request. Legal basis: Art. 6 (1) (b) GDPR insofar as it concerns the use of KynxMachines, otherwise Art. 6 (1) (f) GDPR. We delete the data as soon as your request has been conclusively resolved and no statutory retention obligations apply.
8. Recipients & hosting
The website, downloads and update server are operated via our own hosting platform (KynxGate) on rented server infrastructure. Insofar as an external data centre operator may gain access to data, this is done on the basis of a data processing agreement pursuant to Art. 28 GDPR. The connection to kynxmachines.de is encrypted with TLS. Beyond this, we do not pass on personal data to third parties unless we are legally obliged to do so.
9. Your rights
Under the GDPR you have the right to:
- access to the data stored about you (Art. 15 GDPR),
- rectification of inaccurate data (Art. 16 GDPR),
- erasure (Art. 17 GDPR) and restriction of processing (Art. 18 GDPR),
- data portability (Art. 20 GDPR),
- object to processing based on Art. 6 (1) (f) GDPR on grounds relating to your particular situation (Art. 21 GDPR).
Simply contact support@kynxmachines.de. You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:

10. Other
Providing your data is neither legally nor contractually required; however, without the technically necessary connection data, the website, downloads and updates cannot be delivered. No automated decision-making, including profiling, takes place.
We adapt this privacy policy when our service or the legal situation changes. The version published here applies.
