Terms of Use

§ 1 Scope & provider

(1) These terms of use apply to the use of the software "KynxMachines" (hereinafter "software") and the website kynxmachines.de.

(2) The provider is KynxStudios, owner Julius Zeeck (sole proprietor), c/o Online-Impressum #4888, Europaring 90, 53757 Sankt Augustin, Germany, email: support@kynxmachines.de (hereinafter "we").

(3) By installing or using the software, you agree to these terms. Deviating terms of the user do not apply.

§ 2 Description of services

(1) The software makes it possible to create, manage and display virtual machines (VMs) on a Windows PC with Hyper-V, including automatic download of operating system images from official sources.

(2) The software is provided free of charge. There is no entitlement to provision, specific features, further development, support or permanent availability of the website and the update server.

(3) Should we offer paid features in the future, this will only happen after prior explicit information and consent; features that were previously free will not retroactively become subject to charges.

§ 3 Right of use

(1) We grant you a simple, non-exclusive, non-transferable right, revocable at any time with effect for the future, to install and use the software on your own devices for private and commercial purposes.

(2) Without our prior consent, you may not sell, rent or pass on the software for a fee, distribute it in modified form, or remove copyright notices, signatures or markings. Passing on the unmodified, original installer or referring to kynxmachines.de is permitted.

(3) Decompiling and reverse engineering are only permitted to the extent mandatorily allowed by law (Sections 69d, 69e of the German Copyright Act).

§ 4 System changes & backups

(1) The software requires administrator rights and, at your request, makes changes to the system, in particular enabling Hyper-V, creating virtual hard disks and networks, and restarts. In Windows VMs it also installs the helper program KynxClip for the shared clipboard; for sound mode, after your confirmation in the VM, it sets up the VM to stay unlocked after sound mode. You make settings in the BIOS/UEFI (e.g. virtualization) yourself.

(2) Virtual machines use memory, processor power and storage space. You are responsible for ensuring that your system is suitable and that – as with any system-level software – you make an appropriate backup of your data before use.

§ 5 Third-party software & licenses

(1) Operating systems and other software that you download with KynxMachines or install in VMs come from third parties (e.g. Microsoft, Canonical, Linux Mint, Fedora Project, Debian Project) and are subject exclusively to their license terms. We do not provide this software ourselves and give no warranty for it.

(2) In particular, Windows requires a valid license from Microsoft even in a virtual machine. You alone are responsible for properly licensing all software used in your VMs.

(3) The software contains open-source components (including Electron and React). The respective open-source licenses shipped with the software apply to them; these terms of use do not restrict the rights granted there.

§ 6 Obligations & AI agents

(1) You use the software only within the framework of applicable law. In particular, using it to commit or prepare criminal offences, to attack third-party systems, to distribute malware, for spam or to circumvent third-party protective measures is prohibited.

(2) If you use automated programs or AI agents in your VMs (e.g. "computer use"), you yourself are responsible for their actions, the accounts and services used, and compliance with the terms of use of these services. Isolation in a VM does not replace your own review and monitoring.

(3) The optional network protection (Tor, VPN, proxy) increases privacy but does not guarantee complete anonymity or security. You are responsible for using it lawfully and for complying with the terms of the respective services (e.g. the terms of use of your VPN provider such as Proton VPN, including any restrictions of free plans). You provide connection data and credentials for VPNs or proxies yourself; we do not provide our own VPN servers.

§ 7 Updates

(1) The software automatically checks for new versions and downloads them in the background (see privacy policy). Updates are installed at the push of a button or automatically the next time the software is started or quit.

(2) Updates serve security, bug fixing and further development. We may change or remove features in the process, insofar as this is reasonable taking your interests into account.

§ 8 Defects

Since the software is provided free of charge, we are only liable for material defects and defects of title if we have fraudulently concealed a defect (Sections 523, 524 of the German Civil Code, applied accordingly). We are nevertheless happy to receive bug reports and try to fix them.

§ 9 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, for fraudulent concealment of a defect and under the German Product Liability Act.

(2) Otherwise, our liability is excluded in accordance with the gratuitous nature of the provision (Section 521 of the German Civil Code). This applies in particular to data loss, damage to hardware or software and lost profits based on slight negligence.

(3) The above limitations also apply in favour of our vicarious agents.

§ 10 Term & termination

You can stop using the software at any time by uninstalling it. Your virtual machines remain on your computer and can continue to be used with Hyper-V or deleted. We may revoke the right of use in the event of serious violations of these terms.

§ 11 Changes

We may change these terms of use with effect for the future, for example for new features or changes in the law. We will inform you of material changes on this website or in the software. If you continue to use the software after the changes take effect, the amended terms apply; if you object, you can stop using the software at any time.

§ 12 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU member state, the mandatory consumer protection provisions of that state remain unaffected.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is our registered office.

(3) Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision.
